At MFB, intellectual property procurement and related counseling is not an entrée to more lucrative work — it is the foundation of our practice.  

The firm’s patent prosecution practice focuses on the formulation and execution of technology protection strategies.  Our prosecution approach is aggressive, with significant emphasis on applying advocacy skills to obtain the desired protection. In pursuing protection, we frequently draw upon our collective experiences, taking advantage of long-term working relationships of our attorneys as well as the varied technical expertise of our attorneys.  Areas of our patent prosecution practice include chemical processes,  pharmaceuticals, electrical devices, mechanical and electromechanical devices including medical devices, materials science, software applications and business methods.  In addition to domestic representation, we work closely with a trusted worldwide network of firms to obtain global patent protection on behalf of our clients.

In addition to patent procurement, a significant part of our practice includes client counseling and other transactional aspects of intellectual property law, including supporting the development, acquisition and exploitation of protected positions. Such support includes negotiating and drafting various licensing and other technology-based agreements, as well as evaluating and rendering opinions relating to infringement and validity. Other services include product clearance, due diligence for mergers and acquisitions, and pre-litigation analysis and counseling. We also prepare, file and prosecute trademark applications, both domestically and worldwide, and provide counseling with respect to trade secret maintenance and misappropriation.

Should specialized intellectual property enforcement or defense needs arise, the firm interfaces closely with the litigation counsel of our clients choosing.  We believe that this approach provides flexibility that allows our clients to select litigation counsel that best suits their needs for a particular matter.
